Should Delaware Be Concerned that Its Corporate Law Dominance Is Threatened?

We have written periodically on these pages about the tension between the dominance in corporate law that Delaware enjoys and the risk that Federal law will continue to encroach on the field of corporate governance moreso than it has in the past. Here is an article in today’s Wilmington News Journal  that discusses the topic from various angles. Professor Mark Roe of Harvard Law School, who was quoted in the article, gave a speech on the topic a few months ago that is highlighted here. Much has been written on this issue by many people.
