Much has been written on this blog about e-discovery in general and the new Federal Rules on e-discovery in particular–which will become effective on Dec. 1, 2006. Craig Williams and Robert Ambrogi have a podcast, which is similar to an audioclip available via the Internet, which is a good discussion of key parts of the new rule that will impact every litigator. Even if not strictly applicable to the state courts, it will be hard for the state courts to ignore the impact of the new e-discovery rules, especially in Delaware, where the state rules of civil procedure are based on the Federal rules.
