Frank Reynolds of Thomson Reuters provides a helpful summary of a seminar at the Widener University School of Law last week which featured members of Delaware’s Supreme Court, Court of Chancery, Superior Court Complex Commercial Litigation Division and the Bankruptcy Court for the District of Delaware. The jurists and other panelists discussed the manifold areas where the jurisdiction of those courts overlap and ideas for potential future collaboration. For example, one idea posed was to allow the Bankruptcy Court to certify questions of Delaware law directly to the Delaware Supreme Court similar to the existing procedure for the SEC and other courts to do so.
