Benning, download file, the Delaware Supreme Court determined that under applicable New York law, the plaintiffs did not satisfy the “injury in fact” or “fact of harm” requirement and therefore could not satisfy the predominance of common issues of law or fact requirement under Delaware Superior Court Rule 23(b)(3). Therefore the case could not proceed as a class action.
