Generally, I summarize court opinions only on this blog, and not decisions that are designated merely as orders of the court, but a recent Order of the Supreme Court contains citations to cases and has a discussion of recent Delaware law on a topic near and dear to most attorneys: fees awardable by the court. Rapuano, download file, the Delaware Supreme Court affirmed the decision from the bench of the Chancery Court in which it was determined the there was not a basis to apply the “bad faith” exception to the American Rule that each party bears its own fees.
